Agreement to Terms

By accessing or using the Oval Creative website, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this site.

Use License

Permission is granted to temporarily view the materials (information or software) on Oval Creative's website for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:

Services

Monthly Packages

Our monthly packages are subscription-based services. Payment is due monthly in advance. You may cancel your subscription at any time with 30 days' notice. Upon cancellation, you will continue to have access to services until the end of your current billing period.

Custom Projects

Custom project terms, including scope, timeline, and payment schedule, will be outlined in a separate project agreement.

Payment Terms

Monthly subscriptions are billed automatically on the same day each month
Late payments may result in suspension of services
All fees are non-refundable except as required by law
Prices are subject to change with 30 days' notice

Intellectual Property

Upon full payment for services, you will own the final deliverables. However, Oval Creative retains the right to use completed work in our portfolio and marketing materials unless otherwise agreed in writing.

Any pre-existing intellectual property, third-party components, or open-source software remains the property of their respective owners.

Client Responsibilities

As a client, you are responsible for:

Providing accurate and complete information
Timely review and feedback on deliverables
Providing necessary content, images, and materials
Ensuring you have rights to all materials provided to us
Complying with all applicable laws and regulations

Warranties and Disclaimers

We warrant that our services will be performed in a professional and workmanlike manner. However, we make no warranties regarding specific results or outcomes.

The materials on Oval Creative's website are provided on an 'as is' basis. We make no warranties, expressed or implied, and hereby disclaim all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

Limitation of Liability

In no event shall Oval Creative or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on our website or services, even if we have been notified of the possibility of such damage.

Indemnification

You agree to indemnify and hold Oval Creative harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or breach of these terms.
